What to do if a NYC contractor does a bad job
How to document the problem, try to fix it directly, and file a complaint with the city.
- Gather your records. Keep the contract, invoices, payment records, messages and dated photos.
- Contact the contractor in writing. Explain the problem, say what you want done, and give a reasonable deadline.
- Hold back further payments for disputed work where your contract allows it, and consider legal advice for a large amount.
- File a complaint with the city. The NYC Department of Consumer and Worker Protection takes complaints about home improvement contractors. You can start through NYC 311.
- Consider small claims court for smaller amounts, or speak with a lawyer about larger losses.
Why a license matters here
A licensed contractor answers to the city's licensing rules, and the Home Improvement Trust Fund may help in some cases where a licensed contractor fails to do the work. Hiring someone unlicensed can leave you with fewer options. This guide is general information and isn't legal advice.
